Passaic County Prosecutor Camelia M. Valdes announces the arrest of Dr. Barry Sloan, age 60, of Fort Lee, New Jersey. Dr. Sloan, a Doctor of Osteopathic Medicine, ran a medical practice out of Rehabilitation Medical Center of New Jersey located at 2035 Hamburg Turnpike, Suite G, Wayne, New Jersey.

During 2016, Dr. Sloan overprescribed oxycodone, a highly addictive pain medication and other narcotics to patients who had no legitimate medical need for them. Dr. Sloan wrote prescriptions without medical justification, and without development of a treatment plan. Dr. Sloan required patients to pay by money order to hide the illegal prescriptions from health insurance companies, and to disguise the source of the funds. Dr. Sloan also failed to pay New Jersey Income Tax on revenue he derived from the practice.

Dr. Sloan is charged by way of summons complaint with Distribution of Controlled Dangerous Substances (NJSA 2C: 35-5) a third degree offense; Illegally Prescribing Prescription Legend Drugs (NJSA 2C:35-10.5) a second degree offense; Financial Facilitation of Criminal Activity (Money Laundering) (NJSA 2C: 21-25) a second degree offense; Failure to Pay State Income Tax (NJSA 54:52-9) a third degree offense; and Failure to File a State Tax Return (NJSA 54:52-8) a third degree offense.

A third degree offense is punishable by three to five years in New Jersey State Prison. A second degree offense is punishable by five to ten years in New Jersey State Prison.

The arrest is the result of a two year investigation conducted by the Passaic County Prosecutor’s Office Narcotics Task Force and the Passaic County Prosecutor’s Office Financial Crimes Unit, the Wayne Police Department, the U.S. Drug Enforcement Agency, the Office of Attorney General’s Consumer Affairs Enforcement Bureau and the New Jersey Department of Taxation.

A criminal complaint is merely an accusation. Despite this accusation, the defendant is presumed innocent unless and until proven guilty beyond a reasonable doubt.
