Daniel Rivera age 42 of North Bergen has been arrested and charged with Possession with intent to Distribute CDS/ Cocaine( 2nd Degree), Possession with intent to Distribute CDS/ Cocaine within 1,000 ft. of a School, Possession with intent to Distribute CDS/ Marijuana, Possession with intent to Distribute CDS/ Marijuana within 1,000 ft. of a School, Possession of CDS Paraphernalia with intent to Distribute, Driving while Intoxicated, Driving while intoxicated within 1,000 ft. of a School, Reckless driving, and Refusal to Submit for Breathalyzer according to Hoboken Police.
At 11:43 PM on 10/21/18 officers were out with a vehicle stopped on the sidewalk running and appeared to have hit the fire hydrant. They found the arrestee in the Driver’s seat passed out or sleeping. Once the officers woke the arrestee he exhibited signs of being intoxicated. Officers were able to smell coming from within the vehicle as well as the odor of Raw Marijuana. When the arrestee was removed from the vehicle a black zip lock bag was scene on the front seat from which was an odor of Raw Marijuana. The arrestee was placed under arrest and handcuffed. As officer searched him he kept twisting his body in an attempt to obstruct the search. The arrestee and the vehicle both successfully searched and the searches yielded the following: 11 small zip lock bags of suspected CDS Cocaine, a Tupperware containing suspected CDS Cocaine ( 20 grams total Cocaine), 4 sandwich baggies with suspected CDS Marijuana, 2 smaller baggies containing suspect CDS Marijuana( 120 grams total Marijuana), a digital scale , unused empty plastic baggies, and an open container of alcohol. The arrestee was brought to headquarters , processed and remanded to the Hudson County Rehabilitation Center.
The cocaine has an estimated street value of $1,600.00 ( $80.00 per gram) and the Marijuana $800.00 ( $200.00 an ounce). The arrestee faces up to 10 years imprisonment for the 2nd degree charge, up to 5 years imprisonment for each 3rd Degree charge ( 3 charges) and up to 18 months imprisonment for each 4th degree charge (2 charges) if convicted.
