BAYONNE — City officials have posted a $3 million special emergency ordinance to cover “contractually required severance liabilities resulting from the layoff or retirement of employees” — but Bayonne’s own public records disagree on when the Municipal Council will hold the public hearing.
The city’s Ordinances page lists Ordinance O-3 (and companion bills O-4 through O-7) with status “Public Hearing 10/07/26 6:00pm.” The Sept. 16, 2026 Regular Meeting agenda, when those ordinances were introduced, instead fixed the hearing for Wednesday, October 14, 2026 at 6:00 p.m. at Dorothy E. Harrington Council Chambers, 630 Avenue C. As of Tuesday afternoon, Oct. 6, the expected Oct. 7 Council agenda PDF (…/agendas/2026-10-07-Council-Agenda.pdf) still returned 404. Hudson TV is not declaring which date is correct.
What’s in the $3 million bill
Posted ordinance text for O-3 appropriates $3,000,000 under N.J.S.A. 40A:4-53(h) as a special emergency appropriation for contractually required severance from layoffs or retirements. The estimated cost of those liabilities is stated as $3,000,000.
Financing language says the portion financed must be put into succeeding annual budgets by including at least one-fifth of the amount authorized, under N.J.S.A. 40A:4-55. A copy must be filed with the Director of the Division of Local Government Services. The ordinance takes effect upon final passage and dissemination through the city’s website as required by law.
What the ordinance does not say: which departments or unions are affected; how many employees face layoff or retirement; whether the costs are police, fire, civilian, or mixed; or why the city is using a special emergency appropriation instead of an ordinary budget line. No headcount or department breakdown appears on the face of O-3.

- O-4 — Road improvements: appropriate $1,600,000; bonds/notes not to exceed $867,633; expected NJDOT FY2026 Municipal Aid grant $732,367. Streets described only as “various.”
- O-5 — Road improvements: appropriate $2,000,000; bonds/notes not to exceed $570,593; expected grants NJDOT FY2025 Municipal Aid $629,407 plus Local Transportation Projects Fund $800,000. Streets “including but not limited to 2nd Street, 4th Street and W. 9th Street.”
- O-6 — Salary ranges: Department Directors $85,000–$225,000; statutory employees (Clerk, CFO, Tax Collector, Tax Assessor) $75,000–$185,000; Tax Assessor step scale from $131,834 to $147,137.
- O-7 — Handicapped residential parking zones: delete four listings, add two (narrow traffic amendments).
Open questions before a final vote
- Hearing date: Website says Oct. 7; introduction agenda said Oct. 14; Oct. 7 agenda PDF missing — residents should check both dates and the city site before showing up.
- Workforce impact: Which layoffs or retirements drive the $3 million? How many people? Which departments?
- Why special emergency? State law allows this tool for contractually required severance after layoff/retirement — but the ordinance does not explain why an ordinary appropriation was not used.
