Incident Detail: On September 08, 2020, at about 2:45 PM, Officer Wilfredo Gomez and Officer Jason Montalvo responded to 400 Newark Street on a male who appeared to be passing out at the register of a local establishment. Upon arrival, the officers were informed by the caller that the male in question kept nodding out while he was on line and had to be woken up several times. The caller then pointed out the male who was now operating a motor vehicle. He was stopped by the exit of the parking lot and appeared to be stopped for some time. The vehicle then exited the parking lot before the Officers were able to approach and conduct a motor vehicle stop. The officers returned to their vehicle and immediately caught up with the suspect. A motor vehicle stop was conducted in the area of 59 Adams Street. Upon speaking to the driver, Officer Montalvo and Officer Gomez believed the operator was operating a motor vehicle while under the influence. The operator was identified as Shaun Cheney 39 y/o Male from Hoboken, NJ. Officer Anthony Rutkowski responded and performed a field sobriety test. At the end of the test Officer Rutkowski determined that Cheney was too impaired to safely operate a motor vehicle. Cheney was placed under arrest and transported to headquarters. Cheney was charged with Driving Under the Influence, Reckless Driving, and Driving While Suspended. After being processed he was released to a responsible party.
Defendant is innocent until proven guilty in court of law.
