HOBOKEN — The Hoboken City Council votes tonight on taking back the $8,287,156.09 contract it awarded for the second phase of the Frank Sinatra Drive Complete Streets redesign, after the contractor never executed the deal, according to a resolution on the agenda.
Resolution T4 says the council awarded the contract to Your Way Construction of 404 Coit Street in Irvington on Sept. 17, 2025, by Resolution No. 25-718, after bids were received May 22, 2025. The city’s agenda summary gives the same award date. Under state law and the bid specifications, the resolution says, the winning bidder had 21 days from the award to sign the contract and provide performance bonds, affirmative action documentation and insurance certificates, unless both sides agreed to extend that.
According to the resolution:
- The city “repeatedly sought the cooperation” of Your Way, including an email asking for an update on the unsigned contract and the performance and payment bonds, “to which the City received no response.”
- On Oct. 6, 2026, the city told the company the award would be rescinded unless it signed by Oct. 9.
- The company “did not provide the requested contract documents and bonds by the October 9, 2026 deadline and remained non-responsive as of October 16, 2026.”
The resolution concludes that Your Way “has abandoned the bid award.” It would rescind and revoke the award “in its entirety” and direct the purchasing agent to declare the company’s bid security forfeited to the city “as liquidated damages.” The resolution describes the bid bond as “10% of the bid, but not in excess of $20,000.00”; it does not state a dollar amount.
The city’s agenda summary says “outside counsel advised the City to rebid the project, and NJDOT concurred.”
The resolution refers to the company as both Your Way Construction, Inc. (in its title) and Your Way Construction, LLC (in its operative sections).
The city’s bid notice for the project (Bid No. 25-01, Federal Project No. 1055301, State Job No. 6305318) describes milling and repaving Sinatra Drive, a concrete island separating the roadway from a new bicycle path within the existing roadway width, new ADA-accessible curb ramps, landscaping and pavement markings.
Also on tonight’s agenda
- Garage management (T1): Hoboken would hire LAZ Parking New York/New Jersey, LLC to run Garages B, D, G and Midtown for up to $997,728 a year over two years, from Oct. 21, 2026 to Oct. 21, 2028, with two one-year renewal options. Three bids came in Sept. 24: Metropolis/SP Plus LLC at $956,672, LAZ at $997,728 and Propark America at $1,309,313.34. The resolution calls the low bidder “non-responsive” because its proposed technology “is unable to integrate with the City’s permit system” without “additional development, cost, or modification.” LAZ’s price is $41,056 a year more than the low bid.
- LAZ extension (T3): A separate resolution would extend LAZ’s current garage contract for up to 90 more days, for no more than $260,000, while the city completes the new procurement.
- Fire officers’ deal (A1): A memorandum of agreement with the Hoboken Fire Officers Association, IAFF Local 1076, adds a 2% wage adjustment and revises the Tier 2 salary guide, according to the city’s summary. The summary estimates the 2026 cost at $252,233 ($179,117 in salary and $73,116 in pension costs) and says the deal includes union and member “waivers and releases related to wage-and-hour claims.”
The council meets tonight, Wednesday, Oct. 21, at 7 p.m. at City Hall, 94 Washington St.
Hudson TV asks: Should Hoboken rebid the Sinatra Drive redesign as planned or rethink the project? Reply A: Rebid it. Reply B: Rethink it.
