Hindsight's winning bid tied $175K a year to Hudson County, N.J. jail medical records support

JERSEY CITY, N.J. — The $175,000 a year built into Hudson County’s 2021 computer-services contract with Hindsight, Inc. was priced in the company’s winning bid as support for an electronic medical records system at the county’s Department of Corrections, according to the bid the county released to Hudson TV on Friday.

County Executive Craig Guy’s office described the same money differently. On Oct. 19, Mark Cygan, the office’s communications director, told Hudson TV that “$175,000 per contract year was allocated within the award for the hiring of a Project Management consultant.” He wrote: “This service was never required/requested; therefore, the $175,000 fee was never paid.” Hudson TV reported that explanation on Oct. 22.

What the winning bid shows

The bid’s pricing page, dated Sept. 23, 2021 and signed by Hindsight’s then-president, James Delaney, breaks each year’s price into three columns: county services in general, the Welfare Department, and “Cost for EMR System Support Services: HC Corrections.” EMR stands for electronic medical records.

The corrections column is $175,000 in each of the five years, or $875,000 in all. The bid’s grand total, $11,659,334, is the same amount commissioners approved for the five-year contract in October 2021.

In its cover letter, Hindsight told the county that it had never done that kind of work: “Hindsight Inc.’s Professional Management services has never included Electronic Medical Support Services for Correctional or any other Medical field and thus will need to find a candidate that can meet the criteria as posted in the RFP.”

The company called the $175,000 “a not to exceed estimate” and wrote that it “will not bill for these services until a qualified candidate has been hired and can be provided to the correctional facility. At that point, Hindsight Inc. will bill the County the salary of said employee until the County transfer is completed.”

The bid and the 2021 contract released to Hudson TV don’t say whether anyone was ever hired for the corrections medical records role, or who supported that system during the contract.

How the record came out

Hudson TV asked for Hindsight’s 2021 proposal under the Open Public Records Act. On Oct. 16 the county sent a different Hindsight proposal, dated May 6, 2021, with a seven-year price structure. On Friday morning, First Assistant County Counsel Christine Moro wrote that she had “attached the incorrect proposal” and sent the Sept. 23, 2021 bid, “which was the awarded proposal.” This story is based on that Sept. 23 bid.

Why it matters

The $175,000 line shaped how the county priced its next deal. An Oct. 1 county memo recommending the new seven-year, $25,593,480.20 Hindsight contract put the old contract’s final year at $2,488,170. That is the Year 5 price of $2,663,170 minus the $175,000 corrections line. The memo used that figure to describe the new first-year price, $2,833,237.04, as about 12% higher. By Hudson TV’s math, the increase is 13.9%.

The 2021 contract runs through Oct. 27, 2026, and the new one starts Oct. 28, according to the county’s resolutions. As of Oct. 16, the county said the 2026 contract “has not been fully executed.”

What’s next

  • Hudson TV sent Guy’s office follow-up questions about the 2021 pricing on Oct. 22 and asked for answers by Tuesday, Oct. 27, at 5 p.m. This story will be updated with any response.
  • Hudson TV will report on the signed 2026 contract when the county releases it.
