Paterson Man Indicted on Multiple Counts of Sexual Offenses Against a Child

PATERSON MAN INDICTED ON MULTIPLE COUNTS OF SEXUAL OFFENSES AGAINST A CHILD                                                                                                                                                                                                                              Passaic County Prosecutor Camelia M. Valdes has announced that Gilberto Lopez-Rodriguez, age 43, of Paterson, New Jersey has been indicted on multiple counts of sexual offenses against a child.

A Passaic County Grand Jury has returned Indictment No. 21-08-00515-I, charging Gilberto Lopez-Rodriguez with various sexual offenses against a child that took place at multiple residences in Paterson from February 2014 to February 2015, and then again in January 2020. Mr. Lopez-Rodriguez was indicted on four counts of first degree Aggravated Sexual Assault, in violation of N.J.S.A. 2C:14-2a(1), five counts of first degree Aggravated Sexual Assault, in violation of N.J.S.A. 2C:14-2a(7), four counts of second degree Sexual Assault, in violation of N.J.S.A. 2C:14-2b, five counts of second degree Sexual Assault, in violation of N.J.S.A. 2C:14- 2c(1), five counts of second degree Sexual Assault, in violation of N.J.S.A. 2C:14-2c(3)(c), two counts of second degree Endangering the Welfare of a Child, in violation of N.J.S.A. 2C:24- 4a(1), seven counts of third degree Aggravated Criminal Sexual Contact, in violation of N.J.S.A. 2C:14-3a, and two counts of fourth degree Criminal Sexual Contact, in violation of N.J.S.A. 2C:14-3b.

The sentencing exposure on first degree Aggravated Sexual Assault where the victim is under the age of thirteen is twenty five years to life in New Jersey State Prison, subject to a twenty five year parole disqualifier pursuant to the Jessica Lunsford Act; on first degree Aggravated Sexual Assault, in violation of N.J.S.A. 2C:14-2a(7), it is ten to twenty years New Jersey State Prison, with 85% of the term to be served before parole eligibility pursuant to the No Early Release Act; on second degree Sexual Assault, in violation of N.J.S.A. 2C:14-2b, it is five to ten years in New Jersey State Prison with 85% of the term to be served before parole eligibility pursuant to the No Early Release Act; on second degree Sexual Assault, in violation of N.J.S.A. 2C:14-2c(1), it is five to ten years in New Jersey State Prison with 85% of the term to be served before parole eligibility pursuant to the No Early Release Act; on second degree Sexual Assault, in violation of N.J.S.A. 2C:14-2c(3)(c), it is five to ten years in New Jersey State Prison; on second degree Endangering the Welfare of a Child, it is five to ten years in New Jersey State Prison; on third degree Aggravated Criminal Sexual Contact, it is three to five years New Jersey State Prison; and on fourth degree Criminal Sexual Contact, it is up to eighteen months New Jersey State Prison.

If convicted, Mr. Lopez-Rodriguez is subject to Parole Supervision for Life and Megan’s Law registration requirements. Mr. Lopez-Rodriguez is presently detained at the Passaic County Jail pending the disposition of the charges. Mr. Lopez-Rodriguez is scheduled for arraignment on September 13, 2021, before the Honorable Marybel Mercado-Ramirez, J.S.C.

A criminal indictment is merely an accusation. Despite this accusation, the defendant is presumed innocent unless and until proven guilty beyond a reasonable doubt.
