Passaic County Prosecutor Camelia M. Valdes and Paterson Police Chief Ibrahim Baycora announce that based upon an investigation by the Paterson Police Department, in conjunction with the Passaic County Prosecutor’s Office, Calvin Holmes, 34-years-old from Paterson, New Jersey, was arrested in relation to a shooting investigation that took place December 31, 2021, in the area of Rosa Parks Boulevard and 12th Avenue in Paterson, New Jersey. Calvin Holmes is charged with Attempted Murder, First Degree; Unlawful Possession of a Weapon, First Degree; Unlawful Possession of a Handgun, Second Degree; Possession of a Weapon for an Unlawful Purpose, Second Degree; Certain Persons Not to Have Weapons, Second Degree; and Terroristic Threats, Third Degree.
On December 31, 2021, at approximately 3:15 p.m., members of the Paterson Police Department were dispatched to the area of Rosa Parks Boulevard and 12th Avenue in Paterson, New Jersey on a report of a shooting. Police later determined that a 27-year-old male Paterson resident had sustained a non-fatal gunshot wound during the incident. The investigation revealed that, after a verbal dispute in the area of Rosa Parks Boulevard and 12th Avenue, Calvin Holmes shot the victim and threatened to kill a 27-year-old female Paterson resident.
Based on the investigation, Calvin Holmes was identified as the shooter and a warrant was issued for his arrest. On December 31, 2021, at approximately 8:00 p.m., members of the Paterson Police Department arrested Calvin Holmes in the area of North York Street and Sparrow Street in Paterson.
The sentencing exposure for Calvin Holmes on First Degree Attempted Murder is 10-20 years New Jersey State Prison with 85% of the term to be served before parole eligibility pursuant to the No Early Release Act and 5 years parole supervision; on First Degree Unlawful Possession of a Weapon it is 10-20 years New Jersey State Prison; on Second Degree Unlawful Possession of a Handgun it is 5-10 years New Jersey State Prison with a minimum of 42 months before parole eligibility pursuant to the Graves Act; on Second Degree Possession of a Handgun for an Unlawful Purpose it is 5-10 years New Jersey State Prison with 42 months of parole ineligibility pursuant to the Graves Act; on Second Degree Certain Persons Not to Have Weapons it is 5-10 years New Jersey State Prison with 5 years to be served before parole eligibility, and on Third Degree Terroristic Threats it is 3-5 years New Jersey State Prison.
The State has filed a motion for pretrial detention that will be heard by the Honorable Marybel Mercado-Ramirez on January 5, 2021.
A criminal complaint is merely an accusation. Despite this accusation, defendants are presumed innocent unless and until proven guilty beyond a reasonable doubt.
