David Martinez of North Bergen has been sentenced to 30 years in New Jersey State Prison for his involvement in a 2019 armed robbery and felony murder. According to Bergen County Prosecutor Mark Musella, Martinez was convicted of conspiracy to commit armed robbery, armed robbery, felony murder, unlawful possession of a weapon, and possession of a weapon for an unlawful purpose in connection with the death of David Duque Soto in June 2019.
Musella says on June 29, 2019, Martinez and four co-conspirators planned to commit an armed robbery against Soto. At approximately 6:40 pm, three of the co-conspirators entered Soto’s apartment in Fairview while Martinez waited in a get-a-way car. Soto was shot twice during the armed robbery and died of his injuries.
A jury convicted Soto of the charges against him on March 13, 2023. Hw was sentenced by the Honorable Margaret Foti on April 28.
Martinez is not eligible for parole at any time during his 30 year sentence.
Prosecutor Musella commended the detectives of the Major Crimes Unit, as well as members of the Fairview Police Department for their skill and professionalism in investigating this matter.
